1. Scope

These General Terms and Conditions (GTC) apply to all orders, sales and deliveries of rehabilitation and assistive devices made via the online shop
of Rehabedarf AG, Leuengasse 36, www.rehabedarf.ch.


Any deviating terms and conditions on the part of the customer shall only apply if we agree to their validity in writing.

 

2. Conclusion of the contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding overview of products.
By submitting an order, the customer makes a binding offer.
The contract is only concluded upon receipt of our written order confirmation (email).

 

3. Product information and medical advice

Our rehabilitation products are designed to provide support in everyday life or for therapeutic use.


We do not provide medical diagnoses or treatment recommendations.
For medical queries or advice on choosing a suitable aid, we recommend consulting a qualified professional (doctor, therapist, orthopaedic technician).

Product photos and descriptions may vary slightly, but this does not affect the functionality of the product.

 

4. Prices

All prices are quoted in Swiss Francs (CHF), inclusive of statutory VAT (where applicable), but exclusive of delivery costs.
The prices applicable are those at the time of ordering.

 

5. Payment methods

The following payment methods are available, subject to availability:

- Credit card

- TWINT

- PayPal

- Prepayment / Bank transfer

- Purchase on account (e.g. with external credit check)

In the event of late payment, reminder fees and interest on arrears may be charged.

 

6. Delivery and Shipping

Delivery within Switzerland is made to the address provided by the customer.
Delivery times are not binding unless they have been expressly guaranteed.
We accept no liability for delays caused by suppliers or third parties.

Shipping costs are displayed during the ordering process.

 

7.  Retention of title

The goods remain the property of Rehabedarf AG until full payment has been received.

 

8. Returns and Right of Withdrawal

In Switzerland, there is no statutory right of withdrawal.
A right of withdrawal applies only to damaged or faulty goods.
Returns or exchanges are not permitted for goods in perfect condition.

 

Exclusion from the right of return

Due to health and hygiene requirements, the following items cannot be returned:

- Hygiene products (e.g. toilet aids, seat cushions, care products, incontinence products)

- Products worn on the body (e.g. bandages, orthoses, compression garments)

- Products in the ‘medical devices’ category, provided they have been opened or tested

- Custom-made or individually tailored items

- Electronic devices after they have been put into use

The customer shall bear the return costs, unless otherwise agreed.

 

9.  Warranty / Defects

Customers must inspect the goods immediately upon receipt and report any obvious defects in writing within 7 days.

In the event of justified defects, we offer, at our discretion:

- Repair

- Replacement

Damage caused by improper use, incorrect assembly, wear and tear, or external factors is excluded.

 

10. Liability

We shall only be liable for damage caused by wilful misconduct or gross negligence on our part.
Any further liability – in particular for indirect damage, consequential damage, loss of profit or health complications resulting from improper use – is excluded to the extent permitted by law.

The use of rehabilitation products is always at the customer’s own risk.

 

Instructions for use and safety

Many rehabilitation products are medical devices.
Customers are obliged to read the instructions for use carefully, to use the products correctly and to consult qualified personnel in case of uncertainty.

 

12. Data Protection

Personal data will be treated confidentially and used solely for the purpose of processing the order and in accordance with our privacy policy

 

13. Copyright

All texts, images, product descriptions and designs on our website are protected by copyright and may not be reproduced without permission.

 

14. Applicable Law and Jurisdiction

Swiss law applies.
The place of jurisdiction is Zurich, unless a mandatory statutory place of jurisdiction applies.

 

15. Amendments to the Terms and Conditions

We reserve the right to amend these Terms and Conditions at any time. The version valid at the time of the order shall apply.
